Rezoning

Zoning is the division of a City into districts, or zones, which regulate the use of property and size restrictions for buildings within those districts. On occasion, changing conditions in a specific area may necessitate an amendment to the Zoning Map. Also amendment may be necessary to extend the boundaries of an existing zoning district, to establish an Historic District designation, and / or to establish a Planned Unit Development (PUD).


Applicability

A zoning map amendment is needed for the following reasons:

  • To establish consistency with the Century Plan - Land Use Plan
  • To implement the goals and policies of the Century Plan
  • To respond to changing land use patterns
  • To initiate an Historic District Designation or a Planned Unit Development


Application Submittal Requirements

  • Signed Affidavit on the Pre-Application form
  • Master Application Form
  • Filing Fee
  • A letter of intent which provides written justification for the request

Review Process

A zoning map amendment requires a public hearing before the Planning and Zoning Commission and the City Council. The processing of a Zoning Map Amendment will involve the following steps:

  • Pre-application Conference (required before formal application submittal)
  • Formal Application
  • Review for Completeness of Application
  • Staff Review / Development Review Committee
  • Preparation of Staff Report and Recommendation
  • Planning and Zoning Commission Public Hearing (The Historic and Architectural Review Commission conduct the Public Hearing for Historic District Designations)
  • City Council Public Hearing and First Reading of the Ordinance
  • City Council Second Reading of the Ordinance

* If the Planning & Zoning Commission has recommended disapproval of the amendment a three / fourths vote by all members of the City Council will be required for approval

*If the proposed rezoning of a tract of land has been protested in writing by the owners of at least 20% of the area within 200 feet of the tract, a three / fourths vote by all members of the City Council will be required for approval.


General Review Time

On the current application cycle a Zoning Map Amendment would take approximately 3 months from the date of application to the date of the City Council's 2nd reading of the Ordinance.
